Suzuki sues ten Indian companies for illegal use of brand name


New Delhi, December 08, 2005

 

Suzuki Motor Corporation (SMC), Japan, has filed suits in the Delhi High Court against 10 companies using the word 'SUZUKI' as trademark / part of their corporate names. These companies are in various businesses like finance, textile manufacture, spinning and weaving. Through the suits, SMC has sought injunction against the use of the word 'SUZUKI' by these companies.

SMC is the owner of the registered trademark 'SUZUKI'. The ten companies, against whom SMC has filed the aforesaid suits, are using the word 'SUZUKI' without SMC's permission. 

These companies have no connection with SMC and the use of the word 'SUZUKI' by them creates the impression that these companies are connected to SMC. 

SMC has filed the aforesaid suits as these companies are continuing to use the word 'SUZUKI' despite cease and desist notices.

In India, SMC has granted license to Maruti Udyog Limited (for cars) and Suzuki Motorcycle India Private Limited (for motorcycles and other two wheelers) to use the 'SUZUKI' brand name.

Earlier, on May 25, 2005 SMC had filed a suit in the Delhi High Court against a proprietorship firm calling itself "Suzuki Motors" without the permission of the company. On May 27, 2005 SMC successfully obtained an interim injunction restraining the said firm from using the word 'SUZUKI' as part of its corporate name.

The suits were filed on December 7, 2005 in Delhi High Court.
